El 12 de diciembre de 1997, la Asamblea, por recomendación del Consejo Económico y Social, proclamó el 26 de junio Día Internacional de las Naciones Unidas en Apoyo de las Víctimas de la Tortura , con vistas a la erradicación total de la tortura y a la aplicación efectiva de la Convención contra la Tortura y otros Tratos o Penas Crueles, Inhumanos o Degradantes que entró en vigor el 26 de junio de 1987.
La tortura se considera un crimen en el derecho internacional. En todos los instrumentos internacionales la tortura está absolutamente prohibida y no puede justificarse en ninguna circunstancia. Esta prohibición forma parte del derecho internacional consuetudinario, lo que significa que es vinculante para todos los miembros de la comunidad internacional, aun si un Estado no ha ratificado los tratados internacionales en los que se prohíbe explícitamente la tortura. La práctica sistemática y generalizada de la tortura constituye un crimen contra la humanidad.
