Em 12 de Dezembro de 1997, pela resolução 52/149, a Assembleia Geral das Nações Unidas proclamou 26 de junho o Dia Internacional das Nações Unidas de Apoio às Vítimas da Tortura, com vista à erradicação total da tortura e ao funcionamento eficaz da Convenção contra a Tortura e Outros cruéis, Desumanos ou Degradantes Tratamentos ou Penas, (resolução 39/46), anexo, que entrou em vigor em 26 de Junho de 1987.
A tortura é um crime sob a lei internacional. De acordo com todos os instrumentos relevantes, é absolutamente proibida e não pode ser justificada sob nenhuma circunstância. Esta proibição faz parte do direito internacional consuetudinário, o que significa que é vinculativa para todos os membros da comunidade internacional, independentemente de um Estado ratificou tratados internacionais em que a tortura é expressamente proibida. A prática sistemática ou generalizada da tortura constitui um crime contra a humanidade.
